I put this up in a NID request thread , but it certainly warrants discussion. One of NID's mixes was coming up as deleted on my account in Mediafire. After many emails to and fro from Mediafire, including one where they said that had no record of anyone at Mediafire deleting it, I got this.

I'm not about covering my own arse !! I take pride in the fact that I don't share illegal music, this obviously had NID's permission. I want to know how and why it is happening. ??

That came from Mediafire as I said, and they have already deleted it. Of course it is elsewhere , it's on NID's soundcloud!

oh that's shitty. they don't even name the piece of music. mediafire didn't even ask for that? company has no balls.

honestly, it's no surprise -- do you really think it's legally squeeky clean for DJs to release mix sets? all it takes is one pissed off artist, even though I'm sure most don't care.

^^^ or just one malicious report of any description. ??? I would have thought if a DJ pays for music he would be allowed to use it?? That link is to the mix so they do name the piece of music. When I can do it without getting really angry I am going to find out just what the procedure is. One way or the other it doesn't bode well for DJ mixes. Which means everyone can suffer, particularly DJs , if they can't do promo releases.

Actually, imagine the consequences for MS :shock:

nah, I think it's just because all those file sharing services are shady as fuck. People really use them to send family photos to the inlaws? yeah right, I bet they're 90% piracy.

They probably get served with these letters all day long and take stuff down without a hassle to keep their business going.

I've uploaded the sasha and hernan moonpark set from '03 what maybe 2-3 years ago and it is still there with 1500+ downloads. I uploaded Howells' Tech Trance a year back or so and it mysteriously vanished, but I didn't get an warning letter like that, so with that old set still alive and kicking I doubt it is any access/purging issue. I wonder if the same has happened to me.

I don't think you are quite getting it. I didn't get a letter either, that is a copy of the email I got from Mediafire after hassling them as to why the download wasn't working. I haven't had a problem with any of my older stuff that I know off either, although some have mysteriously vanished. Btw if I just looked, I would say it is till there, it just doesn't work !

The point is, it very well could be the start of something bigger, or it could be something that has been happening and we aren't aware of it.

I want to see just why they feel that any laws apply to this and I would also like to know if just anyone can report that it is unlawful. Basically I want to know who is claiming to be the owner of this sound recording. I'm sure NID thinks it is his!!

Ah oops, I read it too quickly and thought you got that email directly. I am betting that mediafire recieved a DMCA takedown request and just deleted the file no questions asked, as like mentioned above, probably 90% of the stuff on mediafire/megaupload/rapidshare is either porn/warez or other crap like that.

My guess is possibly someone associated with the label in one of the artists in his mix somehow came across this and thought they would lose money because someone would rather 'steal' that tune via this mix vs. paying the label for it. So they asked to take it down and mediafire did since they probably get so many of these they can't even keep up.

Just my 2c of what I think might be going on.

Spot on.

In a nutshell, I think DIDI is trying to ascertain whether there is going to be a crack down on DJ mixes/Promos. By law, I'm sure it's not squeaky clean as some other people have already said. Will they have a crack down? I highly doubt it because.

a) Impossible to police b) Artists would benefit overall from these releases. Free exposure. More sales. No complaints. That's one role of a DJ - to promote material and artists. c) Posting the material online is not really illegal as such. It's more so what is done with the mix after it is downloaded. If it's private use I don't see a problem. If you're playing it in a commerical environment, I'm sure there are royalty issues by doing this.

Just my thoughts anyway...

Most of what you say is right. :They do porn?? :shock: :lol: I want to know precisely. It's a mix so no label, it's not a tune, they refer to this sound recording and it's a full mix. NID tends to change tunes to his style so any artist would find it difficult. It's just not a commercial release . And they are saying they are an organisation of recording companies. I actually think it's more likely that that organisation is sending these out willy nilly to scare people. But they still need someone to report first. I can't tell you how much I resent being treated like a criminal :lol:

Strangely enough they haven't deleted it from my files?? Just can't access it.

No it's not what I am trying to say. I have said exactly what I meant. There obviously is a crackdown happening or this wouldn't have happened to me. I've also just skimmed a little google and it's happening elsewhere.

While your points are logical and make sense they are not a reflection of what is happening in the real world.

A. Since when has that stopped them trying ?? :lol: and they don't have to get everyone, just the soft targets.

B. They do benefit, but surprise, surprise they also like to be paid for their work. If everyone just says Hey I'm giving the artist exposure and doesn't pay, who does?? But this is the crux of the matter, surely if a DJ does buy the track, these tracks are designed to be played in DJ sets, how can they possibly be unlawful. ??? C. Obviously it was deemed to be illegal or they would not have been able to remove my link. Which raises another question. Whose judgment?? What you say here SHOULD be reality. But it isn't ! Maybe we should all be a bit more aware so that we can make it real. Big ask I know :lol:

I think the actual cause is that even though tunes are in a 'mix', you still have to have a license from a licensing authority from all of the labels to play such tunes. This is why NE Expeditions has a different US and UK tracklisting, if you can't clear license rights for EVERY song on your mix, you can't legally sell it without risk of violating copyright.

This is why peoples whitelabel remixes of Billie Jean etc will never be published via an official channel because whoever owns the rights to MJ's music would never allow this to happen without a 1 million dollar figure coming their way, which a small bedroom DJ will no way be ever to pay.

Technically if Diggers and Bedrock/Plastic City/Good Looking/every other dance label decided to lawyer up, they could demand any mixes with any tunes of theirs on this site be taken down or we could get sued because they haven't given us explicit permission to play their music. This isn't going to happen because everyone who loves this music knows that the whole spirit has always been share mixes, explore tunes, buy music profit. This is much different than the new U2 and Lady Gaga cds where there are millions to be made.

Do you know if you are one of those small wedding DJ guys who gets paid to bring your mobile music setup to every wedding reception in town that you can get fined if you don't have an ASCAP license? You have to pay a fee to play these tunes in public places. I even heard of a while back that the NFL was trying to sue some bar(s) which had tv's greater than a certain size (since tv's are getting so big now) because it constituted a "public performance", and the NFL never granted them "public performance" rights. That warning is there, just listen to the very tail end of any NFL broadcast and you will here this disclaimer. It's all just about $, luckily this is still pretty low on the $ factor, so suing us vs suing Justin Beiber fans isnt economically viable, so Beiber it is.

Clearly no one is selling their promo mixes.

We have similar laws here , for djs . Premises have to pay for a license.

Google is proving a rich source at the moment. Some really interesting stuff :lol: One thing I found is that ANYONE can get one of these notices issued and there are a lot of sites that will tell you how to do it. :lol:

I think you might be over thinking this. The file got deleted by mistake, you were hassling them, standard response is to send that letter as it's easier than actually spending time in digging around to see what has gone on.

Do you think they really have the time to go through all the files and listen to them. They know that by sending out that letter it will cover 90% of file uploaders and put an end to all other technical questions in one go.

^^^Err, that letter had my file number in it. I thought the same as you at one stage when they were stalling, obviously because they couldn't be stuffed. I must say it just made me angrier that they would be that stupid :lol: But there is now something I can actually confirm. And I will be looking at the best way to do that.

You actually didn't read very much did you.?? :lol: The letter wasn't from them. Of course they don't listen. It would be based on a DMCA report.

As long as we accept this sort of shit we will continue to get it served up to us.

No but copyright infringement isn't just about selling the product, its about recreating it. If I did a mix and gave it away for free I would still be committing a crime because I haven't approached the artists who made the tracks on it for their permission to use it. The crime is copying it which is illegal. Copying it and selling it is just a bigger crime. 99% of music available on the internet is illegal

You looking for some crazy DJ skillz like Zabiela? I don't have any like that but I love every set from The Revenge that gets posted here. Currently my #1. Downtempo and all tunes are pitched down, totally my style. Don't know if you'd like this but I love it.
