For doing what? Getting caught while being questioned methodically? Anyone can be caught using the methods that top prosecutors use.
It is known that he did not get convicted for leaking anyones name. It was Richard Armitage.
The person that should be shot is Joe Wilson, because he lied in his NYTimes op-ed piece, as noted by the Butler report, and for using his stature to politically propogandize his lies to lash out at the Bush administration.

Re: Top Constitutional Scholars Line up for Libbys Defense
looks like he's going to need their assistance on appeal, now:

Re: Top Constitutional Scholars Line up for Libbys Defense
"No one has been charged with leaking classified information in the case, but a jury found Libby guilty of trying to deceive investigators and a grand jury as to what went on."
I found it interesting that even the fall guy isn't taking the fall for what the trial was supposedly about.
Re: Top Constitutional Scholars Line up for Libbys Defense
judith miller should be the one going back to jail - for her shit reporting on the lead up to the war.
Re: Top Constitutional Scholars Line up for Libbys Defense
I think one of the best parts about this story is that the judge that's smacking Libby around is a W appointee. One of the most important factors in determining whether to suspend imposition of the sentence pending appeal is the likelihood of success on appeal, and he's made a point of saying that it isn't even a close call. That finding (that Libby has to go to jail pending appeal) will be on an abuse of discretion standard, leaving Libby with a really high bar to stay out of prison pending the appeal of his actual conviction.
So you've got a Bush-appointed judge bitchslapping Libby on a routine basis, and folks are still defending the guy like he's done nothing wrong. Good stuff.

That has no relevance whatsoever.

No dice on Libby's appeal to stay out of jail pending appeal:
July 2, 2007 Appeals court rejects Libby?s bid for bail
WASHINGTON (CNN) ? A federal appeals court Monday rejected former White House aide Lewis ?Scooter? Libby?s request to remain free on bond while appealing his March conviction on perjury and obstruction of justice charges.
In an order handed down Monday, a three judge panel wrote Libby ?has not shown that the appeal raises a substantial question? that regular appeals court will consider when its next term begins in September.
A trial judge ordered Libby to serve 30 months in prison, to start when a location is determined by the U.S. Bureau of Prisons, and a date is decided for him to surrender himself at that location.
A court official told CNN Libby?s attorneys may still file for relief from the US Supreme Court, to try to keep Libby out of confinement pending his appeal.
Re: Top Constitutional Scholars Line up for Libbys Defense
and now Bush has commuted the sentence:
WASHINGTON (CNN) -- President Bush has commuted the prison term of former White House aide Lewis "Scooter" Libby, who faced 30 months in prison after a federal court convicted him of perjury, obstruction of justice and lying to investigators.
Re: Top Constitutional Scholars Line up for Libbys Defense
I guess there's really no downside to doing this from Bush's standpoint. On both sides of the spectrum, there are a handful of people, maybe 25%, that will support what their party leader is doing no matter what, and his approval ratings suggest that he doesn't have too many more supporters to lose. Why the hell not commute his sentence? I'm surprised he didn't give him an outright pardon, quite frankly.
Oh well. I have to confess, I was really looking forward to watching Libby being escorted into prison. Guess I'll have to be satisfied with the knowledge that Bush is perhaps the lamest lame duck in history, and the odds of him having any continued relevance for the remainder of his term is nil.
Re: Top Constitutional Scholars Line up for Libbys Defense
either way its a fucking outrage!
this from cnn
"An outraged Joe Wilson, Plame's husband, spoke to CNN shortly after the ruling. The former ambassador had openly questioned the Bush administration's basis for invading Iraq. He and his wife contend her name was leaked to the media as retribution for Wilson's comments. "I have nothing to say to Scooter Libby," Wilson said. "I don't owe this administration. They owe my wife and my family an apology for having betrayed her. Scooter Libby is a traitor."
Re: Top Constitutional Scholars Line up for Libbys Defense
an outright pardon is the least Bush should've done for Libby's unending loyalty ;)
Re: Top Constitutional Scholars Line up for Libbys Defense
All President's do this...no one should be surprised or outraged.

although 100% true, I think it carries special significance with Bush because one of the primary criticisms of Bush -- at least one of my primary criticisms -- is that he believes he is above the law, and that the rule of law does not apply to him or those do his bidding. This puts an exclamation point on that perception, IMO.
Re: Top Constitutional Scholars Line up for Libbys Defense
and while you're at it toasty, let's not forget the criticism he levelled at Clinton for his end of term pardons.

really good article. Hilary Clinton's hypocrisy was definitely not lost on me, but I had not considered the views of those defending Clinton's lie but wanting to see Libby hang and vice-versa. I thought this was spot on:
"There appears to be rank hypocrisy at work here on both sides of the political spectrum," said Joe Gaylord, a GOP consultant who worked for House Speaker Newt Gingrich during impeachment. "It causes Americans to shake their heads in disgust at the political system."
Also, this was really interesting. I had no idea:
Marc Rich had a high-priced attorney for his battles with the justice system. His name was Scooter Libby.
Re: Top Constitutional Scholars Line up for Libbys Defense
hypocrisy in politics? No, never!
Re: Top Constitutional Scholars Line up for Libbys Defense
SCOOTER LIBBY - BUSHE'S PARIS HILTON ? If you lie to protect the president then you're innocent.
The problem is that media try to create an impression what Libby has done is a debate issue. And this is another sign of severe polarization of american politics.
The truth obviously isn't important anymore, Bush set himself above the legal justice. Does democracy still exist in this country?
