this guy who arizona locked up... with the TB strain that cant be stopped.

any prescedent for this? i mean, im all for it personally, we dont need him starting a plague, but is there any previous ruling on the detainment of a person not based on criminal charges and flee risks?

can he go to court to get out? particularly if the WHO and FDA state his confinement is vital. are they enough authority to do so?

need you legal eagles on this.

side note: they should at least give him a TV, kitchen and ammenities. he isnt a cirminal, but they have him in what is comparable to a cell.

First, for the record, the judge ordered this partially on the grounds that the man refused to take any precautions to avoid infecting others. No mask...and from what I remember, he didn't take any medicine. I would say this is on the same lines as a person who knowingly has HIV having unprotected sex with a person and who did not inform this person beforehand.

can't speak to any specifics, but there is precedent to the effect that under certain (typically extreme) circumstances, a private citizen can be compelled to take one for the team for the common good. Normally, however, that's in the context of sacrificing property, not your liberty.

You can also jail someone who is in civil contempt of a court order. Not sure if that's really on all fours, though...
